  1. INTRODUCTION
    Bienvenue sur le site Internet (« Site ») de NAVTEQ.

  2. ACCES AU SITE
    En accédant, consultant et/ou utilisant ce Site, vous reconnaissez avoir lu, compris et accepté ces termes et conditions d’utilisation (« Termes et Conditions d’utilisation »), y compris la politique de confidentialité (« Politique de confidentialité »), et observer les lois et les règlementations en vigueur aux Etats-Unis.  Vous déclarez et certifiez en outre par la présente être âgé d’au moins dix-huit (18) ans. Si vous n’acceptez pas ces Termes, nous vous remercions de ne pas utiliser ce Site ou tout service proposé par l’intermédiaire de ce Site. NAVTEQ se réserve le droit de mettre à jour, modifier, ajouter ou changer de quelque manière que ce soit ces Termes, et d’imposer si nécessaire de nouveaux termes et conditions relatifs à l’utilisation de ce Site. Ces mises à jour, révisions, ajouts, modifications ou règles, termes et conditions supplémentaires (désignés ci-après par l’expression « Termes supplémentaires ») entrent en vigueur sans délai. Ils sont intégrés dans ces termes dès la notification de leur parution, publiée selon les diverses possibilités offertes, et notamment par une annonce sur le Site. La consultation ou l’utilisation de ce Site suite à une telle notification indique que vous acceptez ces Termes supplémentaires.

  3. UTILISATION POSSIBLE DU SITE
    Pour utiliser le Site, vous devez accéder à Internet directement ou par l’intermédiaire de tout dispositif permettant l’accès à un contenu Internet et payer les frais occasionnés par les services liés à un tel accès.

    (a) Individual Non-Commercial Use.  You agree that you are only authorized to visit, view and to retain a single copy of pages of the Site for your own internal non-commercial use and not on behalf of any other person or entities, and that you will not duplicate, download, publish, modify or otherwise distribute any material on the Site for any purpose other than for your own internal non-commercial use.  We post legal notices and various credits on pages of the Site, which may not be removed even in your permitted copies. You may not remove these notices or credits, or any additional information contained along with the notices and credits.

    (b) Restrictions. The information made available through the Site (including without limitation, map data and other content) may only be used in the form delivered to you and may not be subject to any further automated or systematic processing and may not be used for benchmarking or any other commercial purpose. You may not use, and shall not authorize any third party to use, this information to provide, or to enable the provision of, alerts. You may copy the information only as necessary for your personal use to (i) view it and (ii) save it, provided that you do not remove any copyright notices that appear and do not modify the information in any way.  You agree not to otherwise reproduce, copy, modify, decompile, disassemble, create any derivative works of, or reverse engineer any portion of this information, and may not transfer or distribute it in any form, for any purpose, except to the extent permitted by mandatory laws.

Les infractions à la sécurité d’un système ou d’un réseau peuvent entraîner une responsabilité civile ou criminelle. NAVTEQ se réserve le droit d’enquêter sur de tels évènements ayant engendré de telles infractions et de coopérer avec les autorités policières en cas de poursuite d’utilisateurs impliqués dans de telles actions illégales. Vous confirmez avoir compris que des tierces personnes peuvent accéder sans autorisation aux données et aux communications, y compris les e-mails et toute autre communication électronique, lors de l’utilisation d’Internet.

    (e) Vous endossez la responsabilité de tous vos agissements et du contenu de vos publications ou requêtes. Vous confirmez et garantissez que toute information et/ou tout matériau publié ou fourni à NAVTEQ par le biais de ce Site, y compris, mais non limité à, les informations liées à l’inscription ou à la souscription ou destinées à accéder ou à utiliser tout service offert sur ce Site (« Propositions ») est exact, précis, non mensonger, non confidentiel ou autre, n’implique aucune infraction aux droits d’une tierce partie. Vous acceptez de NE PAS utiliser ce Site pour toutes les activités suivantes : (i) transmission ou retransmission de pollupostage, d’informations mensongères ou toutes autres données usurpant de quelque manière que ce soit l’identité de toute personne physique ou morale, mentionnant de manière erronée ou déformant votre identité ou votre affiliation de quelque manière que ce soit ; (ii) utilisation du Site pour toute activité frauduleuse ou illégale ; (iii) envoi d’e-mail, téléchargement ou transmission quelle qu’elle soit, et utilisation de ce Site pour distribuer ou transmettre tout matériau au contenu à caractère illégal, diffamatoire, sexuel, obscène, haineux, raciste, ou moralement répréhensible ; et (iv) transmission de matériau contenant des virus, programmes troyens, vers, bombes à retardement, filtres de contenu ou tout autre routine ou moteur de programmation informatique conçu pour endommager, détruire ou porter atteinte de quelque manière que ce soit au fonctionnement d’un ordinateur ou de ce Site.

    (f) Informations délivrées par ce Site. Toute information publiée dans ce site, y compris, mais non limité à, tout contenu, produit, recommandations de configuration ou spécifications de produit, est présentée sans garantie d’aucune sorte quant à la précision, la performance ou l’adaptabilité à votre recherche ou quant à la conformité à la loi en vigueur. NAVTEQ vous invite à utiliser les informations publiées sur son Site avec précaution et attention.

    (g) Interdiction d’infraction des droits de propriété intellectuelle des tierces parties. La section suivante ne constitue en aucun cas une limite à ce qui est interdit. En outre, sauf cas exceptionnel, vous reconnaissez et acceptez que : (a) toute Proposition devient la propriété de NAVTEQ ; (b) NAVTEQ a le droit de publier les Propositions pour toute utilisation y compris à des fins promotionnelles ou publicitaires, conformément aux termes définis dans la Politique de confidentialité, sans entraîner de compensation d’aucune sorte à votre égard ; (c) toute Proposition publiée sur ce Site est non confidentielle ; et (d) si vous procédez à une telle Proposition, vous admettez, confirmez et garantissez que le propriétaire de cette dernière accorde à NAVTEQ une licence libre de redevance, permanente, irrévocable, et d’une portée mondiale exclusive afin d’utiliser ces informations de quelque manière que ce soit, sur tout support connu ou développé par la suite.  NAVTEQ se réserve le droit d’octroyer des sous-licences à une pluralité de tiers. Dans la présente, le terme « Droits de propriété intellectuelle » regroupe tous les droits protégés par un brevet, une marque déposée, un droit d’auteur et une clause de confidentialité, ainsi que tout autre type de propriété intellectuelle ou exclusivité de tout pays ou juridiction reconnue mondialement, y compris, mais non limité aux droits moraux ou tout droit similaire. 

    (h) Propriété. NAVTEQ se réserve le droit d’ajouter à ce Site du contenu supplémentaire. Ce contenu peut être : du texte, des graphiques, des images, des dessins, des animations, des données audio, des données vidéo, de la littérature ou tout autre matériau distribué par NAVTEQ sur, par le biais ou en lien direct avec ce Site. En outre, NAVTEQ cherche à afficher le contenu de façon pratique et facilement accessible aux utilisateurs. Tout contenu et matériau de ce Site, comprenant, mais non limité à, du texte, des graphiques, des logos, des boutons et des icônes, des images, des clips audio et des logiciels insérés sur ce Site ainsi que tout service proposé par le Site, sont la propriété de NAVTEQ, de ses sponsors ou de ses partenaires commerciaux, et/ou de leurs concédants respectifs, et sont protégés par des droits d’auteurs américains et internationaux, des marques déposées, ou tout autre droit de propriété et de propriété intellectuelle.  La compilation de tout contenu de ce Site est la propriété exclusive de NAVTEQ et est protégée par des droits d’auteur américains et internationaux. Tout logiciel utilisé sur ce Site est la propriété de NAVTEQ ou de ses concédants et est protégé par des droits d’auteur américains ou internationaux. A l’exception du minimum autorisé ou de toute autorisation spécifique de la loi sur les droits d’auteur, toute copie ou exploitation de matériau provenant de ce Site est autorisée selon les Termes expressément définis par la présente ou avec l’autorisation écrite préalable de NAVTEQ ou de tout autre propriétaire d’un droit d’auteur.  Vous reconnaissez ne pas avoir acquis de droits de propriété par le téléchargement de matériau protégé par un droit d’auteur contenu sur ce Site. L’UTILISATION DE TELS OUTILS OU PRODUITS SUR CE SITE EST INTERDITE !

NAVTEQ RECUSE TOUTE RESPONSABILITE QUANT AUX MATERIAUX CONTENUS DANS LES SITES DES TIERCES PARTIES ET/OU AUX SERVICES ASSOCIES, ET NAVTEQ NE PEUT ETRE TENU RESPONSABLE DE LA SECURITE DES INFORMATIONS FOURNIES AUX SITES TIERS.

  5. LIMITATION DE RESPONSABILITE
    SAUF EXPLICITEMENT AUTORISE PAR LA LOI, LA RESPONSABILITE DE NAVTEQ NE PEUT ETRE MISE EN CAUSE EN CAS DE DOMMAGES, Y COMPRIS, MAIS NON LIMITE AUX DEGATS DIRECTS, SPECIAUX, INDIRECTS, DISUASIFS, EXEMPLAIRES, ET/OU ACCIDENTELS RESULTANT DE L’UTILISATION OU DE LA MAUVAISE UTILISATION DU SITE, DE SON CONTENU ET/OU DE TOUT LOGICIEL CORRESPONDANT, MEME SI NAVTEQ OU UN REPRESENTANT LEGAL DE NAVTEQ A ETE AVERTI DE LA POSSIBILITE DE TELS DOMMAGES.  NEANMOINS, POUR TOUTE AUTRE INFORMATION CONTENUE DANS CES TERMES, SI UNE COUR COMPETENTE VENAIT A DECIDER DE LA NON VALIDITE OU DE L’INEXIGIBILITE DES TERMES DE CETTE SECTION OU DE TOUTE AUTRE PARTIE DE CE CHAPITRE, LA RESPONSABILITE TOTALE DE NAVTEQ ENVERS VOUS, OU TOUTE PERSONNE PORTANT PLAINTE PAR VOTRE INTERMEDIAIRE, POUR TOUT DOMMAGE, PERTE, PLAINTE ET/OU MOTIFS D’ACTION EN JUSTICE, POUR CONTRAT, DELIT, NEGLIGENCE OU AUTRE, NE POURRA EXCEDER LA SOMME DE CENT DOLLARS (100 $ USD).  EN OUTRE, VOUS DEVREZ INDEMNISER, DEFENDRE ET ADMETTRE LA NON-RESPONSABILITE DE NAVTEQ, SES SPONSORS, SES PARTENAIRES COMMERCIAUX, SES FILIALES, SES DIRIGEANTS, SES DIRECTEURS, SES EMPLOYES, SES AVOCATS ET SES AGENTS EN CAS DE DOMMAGE, PLAINTE ET ACTION ATTENTEE PAR VOUS OU PAR UN TIERS EN CAS D’UTILISATION DE CE SITE EN INFRACTION AVEC LES PRESENTS TERMES OU EN INFRACTION AVEC LES DROITS DE PROPRIETE INTELLECTUELLE DE TOUTE PERSONNE PHYSIQUE OU MORALE.

  6. LOI APPLICABLE ET ARBITRAGE
    Les lois de l’état d’Illinois (à l’exception des principes de conflits de lois) régissent l’utilisation de ce Site, de ses services et de ces Termes. Vous acceptez que toute plainte ou désaccord lié à ces termes soit soumis à arbitrage à Chicago, Illinois, selon les lois d’arbitrage commercial de l’American Arbitration Association. En respect de l’applicabilité de la loi, tout arbitrage lié à ces Termes ne peut être associé à un arbitrage impliquant toute autre partie de ces termes, par l’intermédiaire d’un acte de procédure d’arbitrage de classe ou autre. NEANMOINS, SELON LES EXIGENCES DE REGLEMENT DE LITIGE DECRITS CI-DESSUS, POUR TOUTE MESURE INJONCTIVE LIEE A L’ACCES, OU L’UTILISATION, DU SITE, Y COMPRIS, MAIS NON LIMITE AUX, SERVICES ASSOCIES, VOUS ACCEPTEZ DE VOUS EN REMETTRE A LA JURIDICTION EXCLUSIVE DES COURS FEDERALES OU DE L’ETAT APPROPRIE SITUEES DANS LE COMTE DE COOK, ILLINOIS, ETATS-UNIS.

  7. RENONCIATION ET DIVISIBILITE
    En outre, aucun retard ou omission par NAVTEQ d’exercer son droit ou tout autre non-respect par rapport à vous quant au respect des Termes doit porter atteinte à un tel droit ou doit être considéré comme une renonciation de la part de NAVTEQ. Si une partie de ces termes est déterminée par une cour compétente comme non valide ou inexigible en partie ou en tout, une telle clause doit, pour cette juridiction, être rendue inapplicable sur la partie non valide ou inexigible sans pour autant affecter la validité ou la force exécutoire de celle-ci dans toute autre juridiction ou des autres informations dans toute juridiction tant que, si une telle clause non valide ou inexigible peut être modifiée de façon à devenir valide aux yeux de la loi, une telle clause est modifiée de façon à être valide dans le délai maximal autorisé par la loi.  

  8. CONTRAT ELECTRONIQUE
    Vous reconnaissez que les présents Termes, associés à l’acte d’utilisation du site et/ou des services offerts sur ou par le biais de ce Site, ont la même valeur légale qu’un contrat écrit portant votre signature et répondent aux mêmes lois que les contrats nécessitant un paraphe ou une signature, et notamment toute loi relative aux preuves littérales. Vous acceptez également de ne pas remettre en cause la validité, l’exigibilité ou l’admissibilité des Termes en raison du fait que ceux-ci ont été autorisés et transmis électroniquement.  Vous reconnaissez en outre avoir eu la possibilité d’imprimer ces Termes.

  9. TAKEDOWN OF MATERIAL.
    If you believe that this Site includes material that constitutes an infringement of your copyrighted work, you can notify us by providing the following:

    The map data and other content for Canada (“Canada Data”) may include or reflect data of licensors, including Her Majesty, Canada Post and the Department of Natural Resources Canada.  Such Canada Data is licensed on an “as is” basis.  The licensors, including Her Majesty, Canada Post and the Department of Natural Resources Canada, make no guarantees, representations or warranties respecting such Canada Data, either express or implied, arising by law or otherwise, including but not limited to, effectiveness, completeness, accuracy or fitness for a particular purpose.

    The licensors, including Her Majesty, Canada Post and the Department of Natural Resources Canada, shall not be liable in respect of any claim, demand or action, irrespective of the nature of the cause of the claim, demand or action alleging any loss, injury or damages, direct or indirect, which may result from the use or possession of the Canada Data.  The licensors, including Her Majesty, Canada Post and the Department of Natural Resources Canada, shall not be liable in any way for loss of revenues or contracts, or any other consequential loss of any kind resulting from any defect in the Canada Data.
