  1. INTRODUCCIÓN
    Bienvenido al sitio web (“Sitio”) de NAVTEQ.

  2. ACCESO AL SITIO
    Al acceder, navegar y/o utilizar el Sitio, usted reconoce haber leído, comprendido y aceptado estos términos y condiciones de uso ("Términos y condiciones de uso"), incluyendo las Normas sobre privacidad ("Normas sobre privacidad") y que cumple todas las leyes y normas vigentes en Estados Unidos. Además, usted afirma y certifica que tiene al menos dieciocho (18) años de edad. Si no acepta o no puede aceptar estos Términos, no utilice el Sitio ni ninguno de los servicios ofrecidos mediante el Sitio. NAVTEQ se reserva el derecho, a su única discreción, de actualizar, revisar, ampliar o modificar de cualquier otro modo estos Términos, y a imponer con la frecuencia que considere necesaria nuevos términos y condiciones adicionales para la utilización del Sitio. Dichas actualizaciones, revisiones, suplementos, modificaciones y normas, directivas, términos y condiciones adicionales (denominadas colectivamente en estos Términos “Términos adicionales”) tendrán vigor de inmediato y pasarán a ser parte de estos Términos al ser hechos públicos, lo cual podrá realizarse por cualquier medio razonable, incluyendo su anuncio en el Sitio. La continuación de su visita o uso del Sitio con posterioridad a dicho aviso implicará de forma inequívoca su aceptación de todos y cada uno de dichos Términos adicionales.

  3. UTILIZACIÓN ACEPTABLE DEL SITIO
    Para utilizar el Sitio usted deberá disponer de acceso a la World Wide Web directamente o mediante dispositivos de acceso al contenido web y abonará todas las tarifas asociadas con dicho acceso.

    (a) Individual Non-Commercial Use. You agree that you are only authorized to visit, view and to retain a single copy of pages of the Site for your own internal non-commercial use and not on behalf of any other person or entities, and that you will not duplicate, download, publish, modify or otherwise distribute any material on the Site for any purpose other than for your own internal non-commercial use.  We post legal notices and various credits on pages of the Site, which may not be removed even in your permitted copies. You may not remove these notices or credits, or any additional information contained along with the notices and credits. 

    (b) Restrictions. The information made available through the Site (including without limitation, map data and other content) may only be used in the form delivered to you and may not be subject to any further automated or systematic processing and may not be used for benchmarking or any other commercial purpose. You may not use, and shall not authorize any third party to use, this information to provide, or to enable the provision of, alerts. You may copy the information only as necessary for your personal use to (i) view it and (ii) save it, provided that you do not remove any copyright notices that appear and do not modify the information in any way.  You agree not to otherwise reproduce, copy, modify, decompile, disassemble, create any derivative works of, or reverse engineer any portion of this information, and may not transfer or distribute it in any form, for any purpose, except to the extent permitted by mandatory laws.

En consecuencia, usted acepta no: (i) acceder a datos o materiales no destinados a usted; (ii) iniciar sesión en un servidor o cuenta a los que no esté autorizado a acceder; (iii) tratar de sondar, examinar o comprobar la vulnerabilidad de un sistema o red para forzar sus medidas de seguridad o autenticación sin la adecuada autorización; ni (iv) tratar de interferir en el servicio a cualquier usuario, ordenador anfitrión o red, incluyendo, sin limitación, mediante envío de virus al Sitio, sobrecarga, "flooding", "mailbombing" o "crashing" en el Sitio. Las violaciones de la seguridad del sistema o red pueden estar sujetas a responsabilidad civil o criminal. NAVTEQ se reserve el derecho a investigar los casos que puedan implicar este tipo de violaciones y puede recurrir y cooperar con las autoridades para iniciar acción judicial contra los usuarios que hayan participado en dichas violaciones. Usted acepta que los datos y comunicaciones, incluyendo correo electrónico y otras comunicaciones electrónicas, pueden ser interceptadas por terceras personas no autorizadas durante la comunicación mediante Internet. 

    (e) Usted es responsable de todas sus actividades y de todo el contenido de cuanto publique o envíe. Usted declara y garantiza que cualquier información y/o material que publique o comunique a NAVTEQ mediante este Sitio, incluyendo, sin limitación, la comunicada com parte de registro o suscripción o para obtener acceso al uso de los servicios ofrecidos en el Sitio (“Contribuciones”), es verdadera, exacta, no inductora a engaño, no propiedad confidencial de otras personas, no en violación de ningún derecho de terceros y ofrecida de buena fe. Usted se compromete a no utilizar el Sitio para ninguna de las siguientes actividades ni en relación con ellas: (i) transmitir o reenviar correo masivo, correo engañoso o que pretenda suplantar a cualquier persona física o legal, o mentir o falsear su identidad personal en cualquier modo; (ii) utilizar el Sitio para propósitos fraudulentos o ilegales; (iii) enviar correo electrónico, cargar o transmitir de cualquier otra forma o utilizar el Sitio par fomentar el uso, distribución o transmisión de cualquier tipo de material ilegal, molesto, difamatorio, malicioso, explícito sexualmente o que pueda ser considerado censurable; y (iv) transmitir material que contenga virus, troyanos, gusanos, bombas de tiempo, cancelbots o cualquier rutina de programación destinada a dañar, destruir, interrumpir o disminuir de cualquier otra forma la funcionalidad de un ordenador o el funcionamiento del Sitio. 

    (f) Información revelada a través del Sitio. Cualquier información que le sea revelada a través del Sitio, incluyendo, sin limitación, recomendaciones de contenidos, productos o configuraciones, o especificaciones de productos, no se ofrece con garantía de exactitud, rendimiento o adecuación para el propósito pretendido por usted, ni el cumplimiento de las leyes vigentes. NAVTEQ espera de usted que ejerza la debida precaución, mejores prácticas y cautela en el uso de la información proporcionada a través del Sitio. 

    (g) No viole los derechos sobre la propiedad intelectual de terceros. Sin limitación en cuanto a la anteriormente expuesto, usted no puede utilizar el Sitio, y al utilizarlo se compromete a no: (i) transmitir o publicar Contribuciones que estén sujetas a copyright, salvo que usted sea el propietario del copyright o haya obtenido permiso del propietario del copyright para ello; (ii) transmitir o publicar Contribuciones que revelen secretos comerciales, salvo que usted sea su propietario o tenga permiso del propietario para ello, o (iii) transmitir o publicar Contribuciones que infrinjan los derechos sobre la propiedad intelectual (según se define a continuación) de terceros o violen la privacidad o derechos de publicidad de terceros. Además, salvo indicación expresa en otro sentido, usted acepta y se compromete a que: (a) todas las Contribuciones pasen a ser propiedad de NAVTEQ; (b) NAVTEQ tenga el derecho de publicar las Colaboraciones para cualquier tipo de uso, incluyendo propósitos promocionales o publicitarios, según los términos expuestos en las Normas sobre Privacidad, sin recibir usted ningún tipo de compensación; (c) las Contribuciones que envíe a cualquier parte del Sitio no son confidenciales para cualquier propósito; y (d) si usted realiza una Contribución de este tipo, declara y garantiza que el propietario de dicho contenido ha concedido expresamente a NAVTEQ licencia exclusiva, perpetua, irrevocable libre de royalties y para todo el mundo para utilizar las Contribuciones de cualquier forma, y en cualquier soporte o forma conocida actualmente o desarrollada en el futuro. NAVTEQ tendrá derecho a sublicenciar sus derechos mediante múltiples niveles de sublicencias. A efectos de estos Términos, el término “Derechos sobre la Propiedad Intelectual” significa colectivamente los derechos recogidos en las leyes de patentes, marcas comerciales, copyright o secretos comerciales, y cualquier otro derecho sobre la propiedad intelectual o la propiedad reconocido en cualquier país o jurisdicción del mundo, incluyendo, sin limitación, derechos morales y similares. 

    (h) Propiedad. Con cierta frecuencia, NAVTEQ incluirá muchos contenidos en el Sitio para que sean examinados. Son ejemplos de estos posibles contenidos: textos, gráficos, fotografías, imagines, dibujos, animaciones, audio, video publicaciones y cualquier otro material distribuido por NAVTEQ sobre, a través de o en conexión con el Sitio. Además, NAVTEQ intenta mostrar el contenido de forma que sea fácilmente accesible y resulte útil para usted, el usuario. Salvo para los límites mínimos o expresamente permitidos por las leyes del copyright, no se permite el copiado ni explotación de los materiales procedentes del Sitio excepto que sea permitido expresamente en estos Términos o con permiso expreso por escrito de NAVTEQ y cualquier otro propietario del correspondiente copyright. Usted se compromete a no adquirir derechos de propiedad mediante la descarga de material con copyright procedente del Sitio.     (i) Spidering. EL USO DE CUALQUIER HERRAMIENTA, PROGRAMA ALGORITMO ROBÓTICO O PRODUCTO PARA LA DESCARGA AUTOMÁTICA DEL SITIO O DE CUALQUIERA DE LAS PÁGINAS DEL SITIO INFRINGE LOS DERECHOS SOBRE LA PROPIEDAD INTELECTUAL DE NAVTEQ Y/O TITULARES DE LAS LICENCIAS. ¡NO UTILICE NINGUNA DE DICHAS HERRAMIENTAS O PRODUCTOS EN ESTE SITIO NI EN RELACIÓN CON ÉL!

  4. LIMITACIÓN DE LA GARANTÍA
    EL CONTENIDO, SERVICIOS, INFORMACIÓN Y ACCESO AL SITIO SE OFRECEN “TAL CUAL”, Y SIN GARANTÍA ALGUNA, EXPRESA O IMPLÍCITA, INCLUYENDO, SIN LIMITACIÓN, LAS GARANTÍAS IMPLÍCITAS DE COMERCIABILIDAD, ADECUACIÓN PARA UN FIN CONCRETO, CALIDAD SATISFACTORIA Y NO CONTRAVENCIÓN DE LAS LEYES. NAVTEQ NO GARANTIZA QUE NINGUNA PARTE DEL SITIO FUNCIONE DE FORMA ININTERRUMPIDA NI SIN ERRORES, QUE SE CORRIJAN LOS DEFECTOS O QUE EL SITIO O EL SERVIDOR QUE LO HACE DISPONIBLE ESTÉN LIBRES DE VIRUS U OTROS COMPONENTES DAÑINOS, NI QUE LA TRANSMISIÓN DE DATOS O EL ACCESO AL SITIO SEAN ININTERRUMPIDOS, CONTINUADOS NI LIBRES DE ERRORES. NAVTEQ NO GARANTIZA NI REALIZA MANIFESTACIÓN ALGUNA EN RELACIÓN CON EL USO O LOS RESULTADOS DEL USO DEL SITIO EN TÉRMINOS DE SU CALIDAD, EXACTITUD, PRECISIÓN, FIABILIDAD O CUALQUIER OTRO. POR TANTO, USTED DEBERÁ COMPROBAR LA INFORMACIÓN OBTENIDA DEL SITIO ANTES DE ACTUAR EN RELACIÓN CON ELLA.

    SALVO CUANDO SE OFREZCA DE FORMA EXPRESA, NAVTEQ RECHAZA EXPRESAMENTE CUALQUIER RESPONSABILIDAD POR LA PRECISIÓN, CONTENIDO, DISPONIBILIDAD DE LA INFORMACIÓN, PRODUCTOS, SERVICIOS O MERCANCÍAS QUE PUEDA EN CONTRAR EN SITIOS DE TERCEROS CON ENLACES A O DESDE ESTE SITIO. NAVTEQ RECHAZA CUALQUIER RESPONSABILIDAD POR LAS FUNCIONES DE PEDIDO DE PRODUCTOS O SER ICIOS, O LA CONFORMIDAD DE ESTOS PRODUCTOS O SERVICIOS CON LAS GARANTÍAS O ESPECIFICACIONES DE CUALQUIER FABRICANTE. NAVTEQ NO SE RESPONSABILIZA DEL MATERIAL CONTENIDO EN SITIOS DE TERCEROS Y/O LOS SERVICIOS RELACIONADOS NI GARANTIZA NI REALIZA MANIFESTACIÓN ALGUNA SOBRE LA SEGURIDAD DE LA INFORMACIÓN QUE LE PUEDA SER SOLICITADA DESDE SITIOS DE TERCEROS.

  5. LIMITACIÓN DE LA RESPONSABILIDAD
    HASTA EL ALCANCE MÁXIMO PERMITIDO POR LA LEY, BAJO NINGUNA CIRCUNSTANCIA, INCLUYENDO, SIN LIMITACIÓN, NEGLIGECIA POR PARTE DE NAVTEQ, NAVTEQ NO SERÁ RESPONSABLE DE CUALQUIER TIPO DE DAÑOS, INCLUYENDO, SIN LIMITACIÓN, DAÑOS DIRECTOS, ESPECIALES, INDIRECTOS, PUNITIVOS, CONSECUENCIALES, EJEMPLARES Y/O INCIDENTALES QUE RESULTEN DEL USO O INCAPACIDAD PARA EL USO DE ESTE SITIO, CONTENIDO Y/O SOFTWARE RELACIONADO, INCLUSO SI NAVTEQ O UN REPRESENTANTE AUTORIZADO DE NAVTEQ HAYA SIDO AVISADO DE LA POSIBILIDAD DE ESTOS DAÑOS. NO OBSTANTE CUALQUIER OTRA PARTE DEL CONTENIDO DE ESTOS TÉRMINOS, EN EL CASO DE QUE LOS TÉRMINOS DE ESTAS SECCIÓN O CUALQUIER PARTE DE ESTA SECCIÓN SE ESTIMEN INVALIDADOS O NO COERCIBLES POR UN JUZGADO DE UNA JURISDICCIÓN COMPETENTE, EN NINGÚN CASO LA RESPONSABILIDAD TOTAL DE NAVTEQ HACIA USTED O HACIA CUALQUIER PERSONA QUE ACTÚE EN SU NOMBRE, EN RELACIÓN CON DAÑOS, PÉRDIDAS, RECLAMACIONES Y/O CAUSA DE ACCIÓN LEGAL, YA SEA POR CONTRATO, PERJUICIO, NEGLIGENCIA U OTRO, NO EXCEDERÁ DE CIEN (100) DÓLARES ESTADOUNIDENSES. ADEMÁS, USTED INDEMNIZARÁ, DEFENDERÁ Y EXONERARÁ DE RESPONSABILIDAD A NAVTEQ Y SUS PATROCINADORES, ASOCIADOS COMERCIALES, DIRECTORES, DIRECTIVOS, EMPLEADOS, ABOGADOS Y AGENTES, POR Y CONTRA CUALQUIER TIPO DE DAÑOS, RECLAMACIONES Y ACCIONES LEGALES EMPRENDIDAS POR USTED O CUALQUIER OTRA PARTE COMO CONSECUENCIA DEL USO DEL SITIO EN FIOLACIÓN DE ESTOS TÉRMINOS O LA INFRACCIÓN POR SU PARTE DE CUALQUIER PROPIEDAD INTELECTUAL DE CUALQUIER PERSONA FÍSICA O JURÍDICA.

  6. LEYES VIGENTES Y ARBITRACIÓN
    Su utilización del Sitio, los servicios y estos Términos se rigen por las leyes del Estado de Illinois (con exclusión de principios de conflicto legal). Usted acepta que las partes dirimirán cualquier reclamación o disputa en relación con estos Términos mediante arbitración vinculantes en Chicago (Illinois) bajo las Reglas de la Asociación Americana de Arbitraje  Hasta el alcance máximo permitido por las leyes vigentes, ningún arbitraje relacionado con estos Términos se unirá a una arbitración que implique a cualquier otra parte sujeta a estos Términos, ya sea mediante auto de arbitraje de clase o cualquier otro. NO OBSTANTES LOS REQUSITOS PARA RESOLUCIÓN DE DISPUTAS ARRIBA EXPRESADOS, PARA CUALQUIER MEDIDA CAUTELAR RELACIONADA CON SU ACCESO O USO DEL SITIO, INCLUYENDO, SIN LIMITACIÓN, LOS SERVICIOS RELACIONADOS, USTED ACEPTA Y SE SOMETE A LA JURISDICCIÓN EXCLUSIVA DE LAS CORTES ESTATALES O FEDERALES DEL CONDADO DE COOK EN ILLINOIS (ESTADOS UNIDOS).

  7. CLÁUSULA DE DESISTIMIENTO Y SEPARABILIDAD
    El retraso u omisión por parte de NAVTEQ en ejercer cualquier derecho o la inobservancia por su parte en relación con estos Términos en ningún caso se tendrá ni podrá ser interpretado como desistimiento por parte de NAVTEQ. Si alguna de las provisiones de estos Términos se juzgase no válida o no coercible en todo o en parte por un juzgado de una jurisdicción competente, dicha provisión quedará sin efecto sólo en cuanto alcanza a dicha provisión, sin que de forma alguna afecte a su validez o coercibilidad en cualquier otra jurisdicción o del resto de las provisiones en cualquier jurisdicción, entendiéndose, sin embargo, que si dicha provisión no válida o no coercible puede ser modificada de forma que sea válida y coercible legalmente, dicha provisión se considerará modificada de forma que sea válida y coercible hasta el alcance máximo permitido por ley.

  8. ACEPTACIÓN ELECTRÓNICA
    Usted acepta que los Términos, junto con el hecho de utilizar el Sitio y/o los servicios ofrecidos en el Sitio o a través de él tienen la misma validez y efecto legal que un contrato escrito con su firma y satisfacen cualquier ley que exija un escrito o firma, incluyendo cualquier Ley de Fraudes aplicable. Asimismo, usted se compromete a no cuestionar la validez, coercibilidad o admisibilidad de los Términos en base a haber sido transmitido o autorizado electrónicamente. Además, reconoce que ha tenido la posibilidad de imprimir los Términos.

  9. TAKEDOWN OF MATERIAL.
    If you believe that this Site includes material that constitutes an infringement of your copyrighted work, you can notify us by providing the following:

    1. a physical or electronic signature of a person authorized to act on behalf of the owner of the copyrighted work
    2. a description of the allegedly infringed copyrighted work
    3. identification of the allegedly infringing material and where on this Site the allegedly infringing material is located
    4. your address, telephone number, and email address
    5. a statement by you that you have a good faith belief that use of the infringing material on this Site is not authorized by the copyright owner, its agent, or the law

    The map data and other content for Canada (“Canada Data”) may include or reflect data of licensors, including Her Majesty, Canada Post and the Department of Natural Resources Canada.  Such Canada Data is licensed on an “as is” basis.  The licensors, including Her Majesty, Canada Post and the Department of Natural Resources Canada, make no guarantees, representations or warranties respecting such Canada Data, either express or implied, arising by law or otherwise, including but not limited to, effectiveness, completeness, accuracy or fitness for a particular purpose.

    The licensors, including Her Majesty, Canada Post and the Department of Natural Resources Canada, shall not be liable in respect of any claim, demand or action, irrespective of the nature of the cause of the claim, demand or action alleging any loss, injury or damages, direct or indirect, which may result from the use or possession of the Canada Data.  The licensors, including Her Majesty, Canada Post and the Department of Natural Resources Canada, shall not be liable in any way for loss of revenues or contracts, or any other consequential loss of any kind resulting from any defect in the Canada Data.
